These Terms of Use (“Terms”) govern access to and use of CryptumPay, including the CryptumPay website, merchant console, payment pages, payment widgets, APIs, webhooks, documentation and related services.
By accessing the website, creating an account, using the merchant console, integrating CryptumPay, initiating a payment through a CryptumPay payment page or otherwise using the service, you agree to these Terms.
If you do not agree to these Terms, you must not use CryptumPay.
For the purposes of these Terms:
“CryptumPay”, “we”, “us” or “our” means the CryptumPay service, website, console, payment pages, APIs, widgets and related services operated by the Administration of CryptumPay.
“Administration” means the administration and operating team of the CryptumPay service.
“Service” means the crypto payment processing services provided through CryptumPay, including crypto invoice creation, payment pages, payment widgets, APIs, webhooks, merchant balances, reporting, AML-related checks where available, conversion functionality where available, and crypto withdrawals.
“Website” means the CryptumPay website available under the CryptumPay domain.
“Console” means the CryptumPay merchant account area.
“Merchant” means a person or business that creates or uses a CryptumPay account to accept crypto payments for goods, services or other lawful purposes.
“Payer” means a customer, user or other person who makes or attempts to make a crypto payment through a CryptumPay payment page, widget, API-based checkout or other CryptumPay payment interface.
“User” means any visitor, Merchant, Payer or other person using any part of CryptumPay.
“Merchant Balance” means an internal accounting record displayed in the Console that reflects amounts received and processed by CryptumPay for a Merchant and available for withdrawal, subject to these Terms, AML checks, security checks, limits, fees, technical availability and applicable restrictions.
“Supported Asset” means a crypto asset supported by CryptumPay at the time of the relevant payment, as displayed in the payment interface, Console, API, documentation or other official CryptumPay interface.
“Supported Network” means a blockchain network supported by CryptumPay at the time of the relevant payment, as displayed in the payment interface, Console, API, documentation or other official CryptumPay interface.
“Transaction Wallet” means a unique wallet address generated by CryptumPay for a specific payment transaction.
“Restricted Person” means any person or entity that is subject to sanctions, located in a restricted jurisdiction, incorporated in a restricted jurisdiction, owned or controlled by sanctioned persons, or otherwise prohibited from using the Service under these Terms or applicable law.
“US Person” means any citizen, resident, entity incorporated or organised in, person located in, or person otherwise subject to the laws of the United States of America.
“Privacy Policy” means the CryptumPay Privacy Policy available at https://cryptumpay.com/policy, as updated from time to time.
CryptumPay is a crypto payment processing service for Merchants.
The Service may allow Merchants to:
CryptumPay is not a bank, electronic money institution, fiat payment institution, card acquirer, investment platform, broker, investment adviser, deposit-taking institution or fiat money remittance service.
CryptumPay does not provide fiat payouts, bank accounts, deposit accounts, electronic money accounts, investment products, yield products, credit products or financial advice.
Unless expressly stated by CryptumPay in writing, CryptumPay does not represent that it is licensed, authorised, registered or supervised as a bank, payment institution, electronic money institution, investment firm, crypto-asset service provider or other regulated financial institution in any jurisdiction.
Information on the Website is provided for general informational and product description purposes. Marketing materials, website pages, blog posts, product descriptions and other public materials do not constitute a public offer, financial advice, legal advice, tax advice or investment advice.
The Service is provided only on the terms set out in these Terms, the official CryptumPay interface, the applicable documentation and any individual written terms agreed with a Merchant.
A Merchant accepts these Terms by creating an account, registering in the Console, integrating CryptumPay, using the API, using a payment widget, creating an invoice, requesting a withdrawal or otherwise using the Service.
A Payer accepts these Terms by initiating or making a payment through a CryptumPay payment page, payment widget, API-based checkout or other CryptumPay payment interface.
A visitor accepts these Terms by accessing or using the Website.
If you use CryptumPay on behalf of a company, organisation or other entity, you represent that you have authority to bind that entity to these Terms. If you do not have such authority, you must not use CryptumPay on behalf of that entity.
These Terms may be made available in multiple languages.
The English version is the controlling version. Any translation is provided for convenience only. In case of any inconsistency between the English version and any translation, the English version prevails.
You may use CryptumPay only if you:
CryptumPay may refuse, restrict, suspend or terminate access to the Service if we determine, in our sole discretion, that a User is not eligible to use the Service.
You must not use CryptumPay if you are:
CryptumPay may block, reject, suspend, delay, return or restrict any transaction, account, withdrawal, refund or other activity if we believe that it may involve a Restricted Person, sanctioned jurisdiction, prohibited counterparty, prohibited activity, AML risk, regulatory risk, security risk or other unacceptable risk.
CryptumPay may refuse to provide the Service in any jurisdiction where the Service would require authorisation, registration, licensing, notification, reporting or other regulatory approval that CryptumPay has not obtained.
A Merchant may create an account in the Console.
CryptumPay may require email verification, two-factor authentication, domain verification, KYC, KYB or other checks before enabling some or all Service functionality.
Withdrawals are not available unless two-factor authentication is enabled.
Until a Merchant successfully completes the required checks and confirms ownership or authorised use of the relevant domain, payments may be processed in test mode or restricted mode. Payments made in test mode are not credited to the Merchant Balance.
A Merchant must not request, encourage or accept real customer payments through test mode unless CryptumPay has expressly allowed this in writing.
The Merchant is responsible for:
If a Merchant shares account access, credentials or API keys with any person, the Merchant remains fully responsible for all resulting actions, losses, errors, transactions and consequences.
The Merchant must notify CryptumPay immediately if it suspects unauthorised access, compromise of credentials, compromise of API keys, unauthorised withdrawal settings or any other security incident.
CryptumPay may provide API access, webhook functionality, payment widgets and related integration tools.
The Merchant is responsible for correct integration of the Service.
The Merchant must keep API keys confidential and must not expose API keys in public repositories, client-side code, unsecured systems or unauthorised environments.
The Merchant may reset API keys through the Console where this functionality is available.
CryptumPay may revoke, rotate, suspend or restrict API keys if we believe that they are compromised, misused, exposed, used in violation of these Terms or associated with suspicious activity.
CryptumPay may introduce or change API limits, rate limits, security requirements, authentication requirements, webhook rules, versioning rules and technical requirements at any time.
CryptumPay may notify Merchants of material API changes by email, through the Console, through documentation, through Telegram support channels or by other reasonable means.
The Merchant is responsible for handling webhooks correctly. CryptumPay is not responsible for losses caused by the Merchant’s failure to receive, verify, process, store or act upon webhooks.
Unless otherwise stated by CryptumPay, the API response is the primary source of payment status information. The Console is an administrative interface and may display updated, delayed or summarised information.
CryptumPay is not responsible for any goods, services, access, digital items, credits or benefits released by a Merchant before the Merchant has received and verified the relevant successful payment status.
CryptumPay generates Transaction Wallets for payments and controls the private keys to wallets used by the Service.
When a Payer makes a payment through CryptumPay, the crypto assets are received by wallets controlled by CryptumPay.
CryptumPay may hold crypto assets received for Merchants in one or more wallets controlled by CryptumPay, including omnibus wallets used for multiple Merchants. The Merchant Balance displayed in the Console is an internal accounting record of the amount attributable to the relevant Merchant, subject to these Terms.
A Merchant does not receive control over any specific on-chain wallet, private key, address, UTXO, token balance or blockchain output while funds are held by CryptumPay.
A Merchant’s right is to request withdrawal of the applicable Merchant Balance, subject to:
Merchant Balances are not bank deposits, electronic money, fiat money balances, insured deposits, securities, investment products or yield-bearing accounts.
No interest, yield or return is payable on Merchant Balances.
CryptumPay supports only the crypto assets and blockchain networks displayed as available in the official CryptumPay interface, Console, API, documentation or payment page at the time of the relevant payment.
The list of Supported Assets and Supported Networks may change at any time.
CryptumPay may add, remove, suspend, restrict or replace any Supported Asset or Supported Network without prior notice where required for technical, security, liquidity, legal, regulatory, AML, sanctions, operational or business reasons.
The availability of a crypto asset or network in one part of the Service does not guarantee that it is available for all features, Merchants, countries, transaction amounts, withdrawals, refunds or conversions.
When a Payer makes a payment through CryptumPay, the Payer must send the exact required amount of the specified Supported Asset through the specified Supported Network to the specified Transaction Wallet.
The Payer is solely responsible for verifying:

Crypto transactions are generally irreversible. CryptumPay does not guarantee that an incorrect, late, unsupported or misdirected transaction can be identified, recovered, credited or refunded.
CryptumPay determines the required number of blockchain confirmations for each payment at its discretion, depending on the relevant blockchain, asset, risk level, technical conditions and other factors.
A payment may remain pending until the required confirmation conditions are satisfied.
CryptumPay may delay, review, hold, reject, return, block or otherwise restrict a payment where the payment is affected by AML risk, sanctions risk, security risk, blockchain issues, network congestion, technical issues, suspicious activity or other risk factors.
Payment processing speed depends on the relevant blockchain network, wallet, exchange, network fees, confirmation requirements, AML checks, security checks and technical availability.
Any statements regarding speed, instant processing, success rates or similar performance indicators are product descriptions only and are not guarantees of uninterrupted, immediate or error-free processing.
If a Payer sends less than the required amount, CryptumPay may automatically generate an additional payment request for the missing amount.
A maximum of two additional payment requests may be generated for one payment.
If the full required amount is not received after two additional payment attempts, the payment may be cancelled.
Where available, the Payer may initiate a refund for the paid amount directly on the payment page, without contacting CryptumPay support or the Merchant.
For refunds caused by underpayment, the Merchant is responsible for the applicable network fee. CryptumPay may deduct the network fee from the Merchant Balance, refund amount, future Merchant Balance, future withdrawal or other amounts payable to the Merchant.
A refund may be unavailable if the refundable amount is lower than or insufficient to cover the applicable network fee.
If a Payer sends more than the required amount, the excess amount may be eligible for refund where technically possible.
Where available, the Payer may initiate a refund of the excess amount directly on the payment page, without contacting CryptumPay support or the Merchant.
For refunds caused by overpayment, the Merchant is responsible for the applicable network fee. CryptumPay may deduct the network fee from the Merchant Balance, refund amount, future Merchant Balance, future withdrawal or other amounts payable to the Merchant.
A refund may be unavailable if the excess amount is lower than or insufficient to cover the applicable network fee.
If a payment is not received before the payment expiry time, the payment may be cancelled.
If a Payer sends funds after the payment expiry time, the Payer must contact CryptumPay support or the Merchant. CryptumPay may review the matter individually but does not guarantee that the payment will be credited, completed or refunded.
CryptumPay may take into account blockchain delays, network congestion, transaction timestamps, transaction broadcast time, payment page status, AML risk and other relevant factors.
CryptumPay has sole discretion to determine how a late payment is handled.
If a Payer sends funds using the wrong asset, wrong network, unsupported network, unsupported token, wrong address or any method not specified on the payment page, the Payer may permanently lose the funds.
CryptumPay has no obligation to recover, credit or refund such funds.
CryptumPay may attempt to review or recover such funds where technically possible, but any such review is discretionary and may be refused.
CryptumPay is not liable for losses caused by wrong asset, wrong network, wrong address or unsupported payment method.
Refunds may be available in certain cases, including underpayment, overpayment, Merchant-approved refund, technical error or other case accepted by CryptumPay.
Refunds may be initiated by the Merchant or, where available, by the Payer through the payment page.
CryptumPay may require additional information before processing a refund, including a refund address, transaction details or proof of payment.
A refund does not have to be sent to the original sending address. If the Payer provides a different refund address, the Payer is solely responsible for ensuring that the refund address, asset and network are correct and compatible.
Refunds are generally processed in the same crypto asset and network as the original payment where technically possible, unless CryptumPay determines that another method is required for technical, compliance, security or operational reasons.
CryptumPay may refuse or delay a refund if:
For refunds caused by underpayment, overpayment, Payer error, Merchant request or Merchant-side issue, the Merchant is responsible for applicable network fees.
If a refund is required due to an error solely caused by CryptumPay, CryptumPay is responsible for the applicable network fee.
If a refund, reversal, adjustment, correction or related network fee becomes payable after the relevant Merchant Balance has been withdrawn, the Merchant must reimburse CryptumPay or maintain sufficient future Merchant Balance to cover the amount. CryptumPay may deduct such amounts from future Merchant Balances, future withdrawals or other amounts payable to the Merchant.
A Merchant may request withdrawal of available Merchant Balance to an external crypto wallet, subject to these Terms.
Withdrawals are available only if the Merchant has enabled two-factor authentication and completed all required checks.
Withdrawals may be processed upon Merchant request or according to a schedule, where such functionality is available.
The standard monthly withdrawal limit is 100,000 USDT, unless individually changed by CryptumPay.
CryptumPay may apply minimum withdrawal amounts based on the relevant network fee, asset, network, technical conditions and risk level.
Withdrawal network fees are paid by the Merchant and may be deducted from the withdrawn amount, Merchant Balance or other amounts payable to the Merchant.
CryptumPay may delay, reject, limit, suspend or review a withdrawal if:
A Merchant is solely responsible for providing a correct withdrawal address, asset and network.
CryptumPay is not responsible for losses caused by an incorrect withdrawal address, wrong network, incompatible wallet, exchange deposit restriction, wallet error or other issue outside CryptumPay’s control.
Where available, CryptumPay may convert incoming crypto assets into USDT for processing, accounting, settlement, volatility management and Merchant withdrawal convenience.
Conversion may be performed through third-party exchanges, liquidity providers or other infrastructure chosen by CryptumPay.
The Merchant has no right to select a specific exchange, venue, liquidity provider, route, execution method or conversion rate provider unless otherwise agreed individually.
Conversion is performed only as part of CryptumPay’s payment processing and settlement functionality. CryptumPay does not provide standalone exchange services, investment services, brokerage services or trading services to Users.
CryptumPay may delay, cancel or restrict conversion due to AML checks, sanctions checks, liquidity issues, exchange restrictions, technical issues, market conditions, asset restrictions or other operational reasons.
Merchant Balance may be displayed in USDT or another unit determined by CryptumPay.
CryptumPay charges a commission for processing payments.
The standard commission is displayed on the Website, in the Console, in the interface or agreed individually with the Merchant.
CryptumPay may offer individual commission rates depending on volume, risk profile, business model, technical setup or other factors.
Unless otherwise agreed, CryptumPay deducts its commission from incoming payments before crediting the Merchant Balance.
The Merchant is responsible for withdrawal network fees.
The Merchant is responsible for network fees related to refunds caused by underpayment, overpayment, Payer error, Merchant request or Merchant-side issue.
CryptumPay is responsible for network fees related to refunds required due to an error solely caused by CryptumPay.
CryptumPay may change commissions, fee rules and fee calculation methods. Changes may be communicated through the Website, Console, email, Telegram support channels or other reasonable means.
Continued use of the Service after a fee change means acceptance of the updated fees.
CryptumPay may require KYC, KYB, AML, sanctions, ownership, domain, business model, transaction and source-of-funds information from any User.
For Merchants, CryptumPay may request information and documents including:
For individuals, CryptumPay may request identity information and supporting documents where required.
CryptumPay may perform AML-related checks on incoming transactions, Merchant accounts, business models, wallet addresses and other activity where available, required or deemed necessary.
CryptumPay may review withdrawal activity for security, sanctions, fraud-prevention, compliance or risk-management reasons, but CryptumPay does not guarantee AML screening of every outgoing address or every withdrawal destination.
If a transaction, account, withdrawal, refund or activity is associated with AML risk, sanctions risk, suspicious activity or prohibited activity, CryptumPay may:
CryptumPay may retain AML, KYC, KYB, transaction and compliance records for as long as required or considered necessary for legal, regulatory, security, accounting, audit, dispute resolution, fraud prevention and compliance purposes.
CryptumPay may refuse to onboard or continue servicing any Merchant without giving reasons.
You must not use CryptumPay for any illegal, fraudulent, abusive, deceptive, harmful, sanctioned or prohibited activity.
Prohibited activities include, without limitation:
High-risk categories may require enhanced review and may be approved, restricted or rejected at CryptumPay’s sole discretion. These may include, without limitation:
Approval of a Merchant does not mean that CryptumPay approves all future activity of that Merchant.
CryptumPay may suspend or terminate a Merchant if its business model, products, services, transaction activity or risk profile changes.
The Merchant is solely responsible for:
The Merchant must clearly inform its customers about prices, goods, services, delivery terms, cancellation terms, refund terms and other material conditions of sale.
The Merchant must not mislead customers regarding the role of CryptumPay.
The Merchant must not represent that CryptumPay is the seller, supplier, merchant of record, guarantor, escrow agent, bank, insurer or dispute resolver for the Merchant’s goods or services.
The Merchant must cooperate with CryptumPay in relation to suspicious activity, transaction reviews, refund requests, AML checks, sanctions checks, customer complaints and compliance matters.
The Merchant must not split transactions, structure transactions, create multiple accounts or use technical methods to avoid limits, checks, fees, restrictions or compliance controls.
CryptumPay provides crypto payment processing infrastructure.
CryptumPay is not a party to the sale of goods or services between a Merchant and a Payer.
CryptumPay does not guarantee the quality, legality, delivery, availability, safety, suitability or performance of any Merchant goods or services.
All disputes regarding goods, services, delivery, quality, cancellation, subscription, access, account credits, customer support or Merchant refund policy must be resolved between the Payer and the Merchant.
CryptumPay may provide technical payment support to Payers, but CryptumPay does not decide commercial disputes between Payers and Merchants.
No chargebacks are available through blockchain transactions. However, a Merchant may choose or be required to issue a refund according to its own terms, applicable law or CryptumPay’s requirements.
CryptumPay may provide saved payment method and recurring payment functionality through the CryptumPay mobile application or other interfaces where available.
Where this functionality is available, a Payer may be able to save a wallet, asset and network for easier future payments.
A Payer may be required to provide a separate confirmation or authorisation for use of a saved payment method with a new Merchant.
Merchants cannot charge a Payer without the Payer’s required confirmation.
Where recurring payments are available, each payment requires the confirmation method specified by CryptumPay, such as approval in the mobile application using Face ID, Touch ID or another confirmation method.
A Payer may cancel or revoke saved payment methods or recurring payment permissions through the CryptumPay mobile application where such functionality is available.
If a Merchant initiates a payment request that the Payer does not confirm, the payment is not completed.
CryptumPay may change, suspend, delay or discontinue saved payment method and recurring payment functionality at any time.
CryptumPay may provide security features such as two-factor authentication, encryption and account security controls.
The Merchant is responsible for using available security features and maintaining secure operational practices.
The Merchant must:
CryptumPay is not responsible for losses caused by the Merchant’s failure to secure its account, devices, email, API keys, credentials, withdrawal addresses or internal systems.
All rights in the CryptumPay service, brand, website, software, interface, APIs, widgets, documentation, designs, text, graphics, code, databases and other materials belong to the CryptumPay team or its licensors.
Users may not:
Merchants may use CryptumPay marks only as permitted by CryptumPay and only to indicate availability of CryptumPay as a payment method.
CryptumPay may use a Merchant’s name or logo in public customer lists, marketing materials or case references only with the Merchant’s permission.
CryptumPay processes personal data in accordance with the Privacy Policy available at https://cryptumpay.com/policy.
By using the Service, Users acknowledge that CryptumPay may process data necessary to operate the Service, maintain security, perform KYC, perform KYB, perform AML checks, provide support, process transactions, maintain records and comply with legal or compliance obligations.
Users must not submit unnecessary personal data to CryptumPay.
Where a separate data processing agreement, privacy policy or other data-related document applies, that document governs the relevant data processing matters in addition to these Terms.
If there is any inconsistency between these Terms and the Privacy Policy regarding personal data processing, the Privacy Policy governs the relevant personal data processing matter.
CryptumPay does not provide legal, tax, accounting, investment, financial, regulatory or compliance advice.
Any information provided by CryptumPay is for general informational purposes only.
Users must obtain their own legal, tax, accounting, financial, regulatory and compliance advice before using the Service.
The Merchant is solely responsible for determining whether its use of CryptumPay is lawful in its jurisdiction and for its business model.
The Merchant is solely responsible for all taxes, duties, reporting obligations, accounting treatment and recordkeeping related to its use of CryptumPay, crypto payments, Merchant Balance, withdrawals, refunds and customer transactions.
CryptumPay does not issue tax, accounting, invoice or act documents unless separately agreed.
Reports and transaction information displayed in the Console are provided for informational purposes and may not be sufficient for the Merchant’s tax, accounting or regulatory obligations.
CryptumPay may retain transaction history and related records for legal, compliance, audit, security, accounting and dispute resolution purposes.
The Service is provided on an “as is” and “as available” basis.
CryptumPay does not guarantee that the Service will be uninterrupted, error-free, secure, compatible with all systems, available in all jurisdictions or available at all times.
CryptumPay may modify, suspend, restrict, replace or discontinue any part of the Service at any time.
CryptumPay is not liable for downtime, blockchain delays, network congestion, wallet issues, exchange issues, API errors, webhook delays, third-party service failures, maintenance, security incidents, force majeure events or other interruptions outside CryptumPay’s reasonable control.
CryptumPay does not provide any service level agreement unless expressly agreed in writing.
To the maximum extent permitted by applicable law, CryptumPay disclaims all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, accuracy, availability, security and compatibility.

To the maximum extent permitted by applicable law, CryptumPay is not liable for:
CryptumPay’s total aggregate liability to a Merchant for all claims arising out of or relating to the Service shall not exceed the amount of fees paid by that Merchant to CryptumPay during the three months preceding the event giving rise to the claim, or 100 USDT, whichever is higher.
For Payers and visitors, CryptumPay’s total aggregate liability shall not exceed 100 USDT.
These limitations apply regardless of the legal theory of liability, whether based on contract, tort, negligence, strict liability, statute or otherwise.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
The Merchant agrees to defend, indemnify and hold harmless CryptumPay, the Administration, team members, contractors, service providers and affiliates from and against any claims, losses, damages, liabilities, penalties, fines, costs and expenses arising out of or related to:
CryptumPay may suspend, restrict or terminate access to the Service if:
Where reasonably practicable, CryptumPay may provide seven days’ notice before terminating a Merchant account for ordinary commercial reasons where no urgent risk exists.
CryptumPay may suspend, restrict or terminate access immediately where required for AML, sanctions, security, fraud prevention, legal, regulatory, technical or risk reasons.
If an account is terminated:
A Merchant account cannot be fully closed while it has a non-zero Merchant Balance, pending transactions, pending refunds, pending adjustments, pending AML review or unresolved obligations.
CryptumPay is not required to restore a terminated account.
CryptumPay may update these Terms from time to time.
Changes may be posted on the Website, in the Console or otherwise communicated by reasonable means.
The updated Terms become effective when posted or on the date stated in the updated Terms.
Continued use of the Service after the updated Terms become effective means acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service.
These Terms are governed by the laws of Montenegro, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Terms or the Service shall be submitted to the competent courts of Montenegro, unless otherwise required by applicable law.
The language of dispute resolution shall be English, unless the competent court requires another language.
Before bringing a formal claim, a User must send a written notice to CryptumPay describing the dispute, the relevant facts, the requested resolution and supporting documents.
CryptumPay will use reasonable efforts to respond within seven days.
Any claim arising out of or relating to the Service must be brought within one year after the event giving rise to the claim, unless a longer period is required by applicable law.

Messages sent through unofficial channels are not considered official communications.
These Terms constitute the entire agreement between the User and CryptumPay regarding use of the Service, unless separate written terms apply.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
CryptumPay’s failure to enforce any provision of these Terms does not constitute a waiver.
Users may not assign or transfer rights or obligations under these Terms without CryptumPay’s prior written consent.
CryptumPay may assign, transfer or delegate its rights and obligations under these Terms where necessary for operation, restructuring, compliance, service continuity or business purposes.
Headings are for convenience only and do not affect interpretation.
